Guardianships

When a parent, loved one or friend has become physically or mentally incapacitated, it may be necessary to petition the Court to seek to have a guardian appointed for that person, in order to be able to make health care decisions or property decisions. In New York, that proceeding is known as an Article 81, Mental Hygiene Law proceeding often referred to as an Article 81 proceedings. We work with the family to obtain the information necessary to prepare the court petition for the appointment of a guardian. We work with the Court Evaluator, the person appointed by the judge to investigate the circumstances of the proceeding, to provide them with accurate information. We litigate the matter to conclusion, whether it is an uncontested matter or a matter which requires a contested hearing. Not only do we represent litigants in these proceedings, but we have also been appointed as Court Evaluator by the judges.
